2. Parent and Guardian Responsibilities
Parents and legal guardians are responsible for ensuring that their students meet all applicable state and local homeschool requirements, including registration, reporting, documentation, and other obligations that may apply in their jurisdiction in order to enroll at Forest Trail Academy.
3. Children’s Online Privacy Protection
Forest Trail Academy respects children’s privacy and is committed to protecting the personal information of children who use our website and educational services.
FTA complies with applicable privacy laws, including the Children’s Online Privacy Protection Act of 1998 (COPPA), where applicable.
Consistent with applicable law, FTA does not:

Unless otherwise required by law, continued use of the website after updated terms become effective constitutes acceptance of the revised terms. If you do not agree with an update, you should discontinue use of the website.
Information on this website is provided for general informational purposes and does not, by itself, constitute a separate contractual commitment regarding future programs, services, or offerings. Enrollment agreements and other applicable written agreements may establish additional terms.

If you wish to create a link to FTA’s website, you must obtain FTA’s prior written permission. Any approved link must not misrepresent our services or suggest an affiliation, sponsorship, or endorsement that does not exist.
10. Tuition and Enrollment
Forest Trail Academy may provide both public-facing website content and restricted areas of its website or learning platform. Access to certain services requires enrollment, account registration, or authorization.
During enrollment, parents, legal guardians, or other responsible account holders agree to the applicable tuition, fees, payment schedule, and enrollment terms.
FTA may offer installment payment plans to help families manage educational expenses. Upon enrollment, the student’s parent or guardian agrees to pay the total tuition for the then-current school year either in full or according to an installment plan. Students on a payment plan that withdraw are responsible for the tuition balance. No records will be issued for students who withdraw with a tuition balance. Tuition includes access to up to six (6) credits. Families who wish to enroll in additional courses may seek permission from our academic counselor. If approved, there will be additional fees for these additional courses. Students must complete ALL work in order to attain grades and or credits.
11. Withdrawal and Refund Policy
Due to the proprietary nature of Forest Trail Academy’s (“FTA”) software, educational content, and intellectual property, FTA offers a five (5) calendar-day refund policy. Families have five (5) calendar days to determine whether the Academy’s programs meet the needs of their student(s).
Refunds will be granted in accordance with this policy, provided that the family submits written notice of withdrawal within the five (5) calendar-day period. The only accepted form of written notice is FTA’s official Student Withdrawal Form, which must be downloaded, completed, signed by the appropriate individual(s), and submitted by fax to the Academy’s office. Verbal withdrawals or withdrawals submitted through any other means will not be accepted.
Eligible refunds will be issued minus the nonrefundable registration fee. No refunds will be issued after the five (5) calendar-day refund period. Students may withdraw from the Academy at any time.
Students must complete all required coursework to receive grades and/or earn academic credits.
12. Financial Responsibility and Late Payments
Parents, legal guardians, or other responsible account holders are responsible for tuition and fees in accordance with the applicable enrollment agreement and payment plan.
FTA may offer interest-free installment plans when payments are made on time and the account remains in good standing.
If an account becomes overdue, additional charges may apply as provided in the enrollment agreement. The original policy provides for a monthly finance charge of 1.5%, equivalent to 18% annually.
Returned checks are subject to a $30.00 Return Check Fee.
The account holder is responsible for all collection costs associated with collection activities for accounts that are cancelled for non-payment. Accounts cancelled or suspended for non-payment are subject to reporting to credit agencies and collection services.
Parents/Guardian/Students on a payment plan that withdraw are responsible for the tuition balance. No records will be issued for students who withdraw with a tuition balance.
13. Suspension, Expulsion, and Withdrawal
Forest Trail Academy seeks to maintain a safe, respectful, and productive learning environment.
Access to private areas of our website or learning platform may be suspended or terminated when a student or user engages in conduct that violates school policies, enrollment terms, or these Terms and Conditions. Examples may include abuse, harassment, unauthorized access, misuse of educational materials, threats, or other serious misconduct.
Suspension is a temporary discontinuance of access to Forest Trail Academy private sections. Students remain enrolled during a suspension and all financial responsibilities remain in effect during a suspension. If a student is expelled for any reason, the financial responsibility still relies on the parent/guardian/student. Parents must pay the remaining balance immediately. Suspension or expulsion can occur for a variety of reasons, including abuse.
14. Privacy and Personal Information
Forest Trail Academy (“FTA”) respects the privacy of its students, families, and website users. FTA maintains a separate Privacy Policy, available on our website, which is incorporated into these Terms and Conditions by reference. We encourage all users to review the Privacy Policy, which may be updated from time to time.
FTA reserves the right to restrict or terminate website access for violations of the Privacy Policy. Although FTA takes reasonable measures to protect personal information, complete security and confidentiality cannot be guaranteed.
FTA may disclose personal information to governmental authorities, law enforcement agencies, or third parties when required by law, subpoena, court order, or other lawful process, or when otherwise permitted by applicable law and our Privacy Policy.
15. Materials Submitted by Users
We welcome feedback and suggestions that help us improve our website and educational services.
If you submit comments, suggestions, ideas, or other materials through our website, you grant Forest Trail Academy the rights reasonably necessary to review, respond to, and use those submissions for legitimate business and service-improvement purposes, subject to applicable law and our Privacy Policy.

Subject to applicable law, disputes arising from these Terms and Conditions or the use of our website will be brought in the appropriate state or federal courts located in or serving West Palm Beach, Florida, where those courts have jurisdiction.
Nothing in this section limits any rights or protections that applicable law requires us to honor.
Our website may be accessed from locations outside Florida or the United States. FTA does not represent that all website content or services are appropriate or available in every location. Users accessing our website from other jurisdictions are responsible for complying with applicable local laws.

To the fullest extent permitted by applicable law, Forest Trail Academy provides its website and digital resources on an “as is” and “as available” basis.

18. Indemnification

Any such indemnification shall be conditioned upon FTA providing reasonable written notice of the claim and cooperating in its defense or settlement. FTA reserves the right, at its discretion, to assume control of the defense of any claim subject to indemnification, including the selection of legal counsel, at the indemnifying party’s expense to the extent permitted by applicable law. No settlement imposing liability, obligations, or admissions of wrongdoing upon FTA may be entered into without FTA’s prior written consent.
FTA further reserves the right to report suspected unlawful activity or wrongdoing to the appropriate governmental or regulatory authorities, as permitted by applicable law.
19. Limitation of Liability
To the fullest extent permitted by applicable law, in the event of a dispute between you and one or more users of this website, you agree to release and hold harmless Forest Trail Academy (“FTA”), its affiliates, officers, directors, employees, agents, attorneys, and representatives from any claims, demands, liabilities, losses, or damages, whether known or unknown, arising out of or relating to such disputes.

For enrolled students and families, the applicable enrollment agreement and other applicable school policies may establish additional requirements relating to tuition, refunds, academic programs, conduct, and access to educational services.
If these Terms and Conditions conflict with a signed enrollment agreement or a mandatory legal requirement, the applicable agreement and law will govern to the extent of the conflict.
